Amicus Curiae Brief on Behalf of the PDI in Support of the Attorney Client Privilege and the Attorney Work Product Privilege



Here is a LINK to the amicus curiae Brief I wrote at the request of the Pennsylvania Defense Institute in favor of the position put forth by the Appellant, The Erie Insurance Exchange, in the case of Fisher v. Erie Insurance Exchange, No. 1597 WDA 2018 (Pa. Super.).

By way of background, this case involves claims of a UIM breach of contract and bad faith arising out of a motor vehicle accident matter.  Notably, the carrier did not assert advice of counsel as a defense to the bad faith claims.

During the course of discovery, the Plaintiff served Requests for Production upon the carrier, one of which Requests demanded the production of a "complete copy of all documentation reflecting any investigation, evaluation and/or valuation of Plaintiffs' claims for underinsured motorist coverage authored, prepared by or obtained [the carrier's defense counsel and/or the defense firm]."

The trial court judge in Blair County ruled for an in camera inspection of the defense attorney's file with respect to the Request for Production at issue.  In response, the carrier objected, citing to the attorney-client privilege and the attorney work product privilege, and this appeal followed.

The amicus curiae Brief argues that, above and beyond the particulars of the narrow discovery dispute presented in this specific case, to allow for any inspection of the defense attorney's file would violate the protections afforded by the attorney-client privilege which has existed for over 300 years in Pennsylvania as well as the attorney work product doctrine. 

It was also asserted in the Brief that, if an inspection of a defense counsel's file is permitted, the danger then exists with such a precedent that these bedrock privileges long recognized in the law could be eroded to the extent that the files of all attorneys could become subject to inspection by opposing counsel.

It was additionally argued in the Brief that, practically speaking, if a judge conducts an in camera inspection of an attorney's file and rules that the contents of the same were not discoverable, then that judge could be disqualified from entering any further rulings in the case given that that judge had viewed non-discoverable information that could color or taint his or her analysis of future issues in the matter.  This is particularly so in a bad faith action which proceeds to a bench trial after the completion of discovery in Pennsylvania state courts.

The parties await an argument date from the en banc Pennsylvania Superior Court on the appeal presented.  I send thanks to the Pennsylvania Defense Institute for the opportunity to assist in this case.

In notable legal news out of Northeastern Pennsylvania, Attorney Matt Keris of the Moosic, Lackawanna County office of Marshall, Dennehey, Warner, Coleman & Goggin was recently installed as the President of the Pennsylvania Defense Institute at their recent Annual Meeting at the Bedford Springs Resort in Bedford Springs, PA. 

Congratulations to a great lawyer and a great person.  The PDI lucky to have him at the helm for the next year.

Pennsylvania Defense Institute Announces Annual Awards




I write to thank those members of the Pennsylvania Defense Institute, a statewide organization of defense counsel and insurance claims professionals, for selecting me to receive the Pennsylvania Defense Institute's 2014 Distinguished Defense Counsel of the Year Award.  I send a special thanks to Attorney Matt Keris, current PDI President, as well as Attorney Thomas McDonnell for suggesting my name in the first place.  I appreciate the honor of this surprise selection and thank you all very much for the same.

The PDI has also announced that they have awarded their Distinguished Insurance Claims Executive to Mark S. Hofer, their Legislator of the Year to Honorable Jake Corman, and their Distinguished Service Award to Justice J. Michael Eakin.

The Award will be handed out at the PDI's Annual Meeting set to take place at the Bedford Springs Resort in Bedford Springs, Pennsylvania on July 18, 2014.

The NEPATLA and the PDI have announced a CLE program and Holiday Happy Hour set for November 13th at the Mohegan Sun Casino at Pocono Downs in Wilkes-Barre. The program will feature recently-appointed Pennsylvania Supreme Court Justice Correale Stevens, Pennsylvania Attorney General Kathleen Kane, and local Judges Richard Caputo, Thomas Burke, Jr., and Robert Mazzoni. Two substantive and one ethics credits are offered. The CLE program is followed by a Holiday Happy Hour at Breakers. The cost of attending the Happy Hour is included in the price of registration ($175 for attorneys; free for non-attorneys).

PDI North Region CLE Continued to December 4, 2013 to Coincide with Holiday Happy Hour

The Pennsylvania Defense Institute has announced that their annual North Regional CLE progam, which was set for August 22, 2013 at Mohegan Sun at Pocono Downs, has been postponed to December 4, 2013 to coincide with a Holiday Happy Hour on the same date

The program is co-sponsored by the Northeast Pennsylvania Trial Lawyers Association.

The afternoon CLE program will be followed by the evening reception.

The program will feature new Pennsylvania Supreme Court Justice Correale F. Stevens, and a panel of local judges.

The cost for lawyers is $175 for the program and reception, and free for all others (insurance claim professionals, law clerks, paralegals, etc...).

PDI ANNUAL CONFERENCE - BEDFORD SPRINGS - JULY 19-20

· Agenda highlights include presentations by Pennsylvania Governor Thomas Corbett and Insurance Commissioner Michael Consedine! There are also presentations on “Post-Koken Auto and Bad Faith Practice” and on “Insurance Fraud and Medical Billing Fraud”. There is also an ethics update for that elusive one hour of ethics CLE credit we all need.


· The 2012 Conference also provides for substantive law committee meetings. So, plan to attend the committee meeting of your choice and network with other PDI members in your area of practice. CLE credit is offered for participation in these meetings. To date, the Motor Vehicle, Employment Law & Civil Rights, and the Products Liability Committees plan to conduct meetings.

· As you know, PDI’s Annual Conference is not all work! We will have our traditional Presidents Reception on Thursday evening. We are also arranging with Bedford Springs activities for the whole family, including golf, hiking, biking, a cooking demonstration and a scavenger hunt. We have not even mentioned the spa and pool that Bedford Springs is famous for! And, there are off-site activities including antique shops, Old Bedford Village, covered bridges tours, Fort Bedford Museum, Gravity Hill and more. So, plan to bring the whole family this year!

· Registration material is being mailed to all PDI members. The charge for lawyers will again be $325 for all events this year. And, again this year there is no charge for insurance claim representatives to attend. We have also again negotiated a reduced rate for golfers of $100 (including cart and greens fee).
