In his recent decision in the case of
Boyle v. Progressive Specialty Insurance Company, No.
8815-Civil-2014 (C.P. Luz. Co. Nov. 3, 2015 Amesbury, J.), Judge William H.
Amesbury of the Luzerne County
Court of
Common Pleas granted an Order without Opinion granting the Motion of the
Plaintiff to Compel a Deposition of the Progressive claims handler.

In granting that Motion, the court further ordered that the
Plaintiffs were precluded from deposing the claims representative as to any
mental impressions, conclusions, or opinions regarding the merit or value of
any claim or defense, or respecting the strategy or tactics in defense of claim
by the carrier.
