Jury Trials Starting to Open Back Up in Luzerne County


Here is a LINK to an article from today's online edition of the WNEP News website reporting on the Luzerne County Court of Common Pleas utilizing the Mohegan Sun Arena and other facilities to start back up jury trials. (Check out the video of the news story in the Link to hear more details on the process from President Judge Michael T. Vough of the Luzerne County Court of Common Pleas).

The alternative venues are being utilized to select jurors with the trials thereafter taking place back in the courtroom with social distancing measures in place.  Some high profile trials will take place completely within the larger alternative venue.

According to the article, jury trials have started back up in Luzerne County under this process and, so far, there has been a good response to the juror summonses sent out to the public.

New Trial on Damages Granted in Luzerne County Zero Verdict Case

In Coopey v. City of Wilkes-Barre, No. 5855 of 2009 (C.P. Luz. Co. July 31, 2014 Hughes, J.),  Judge Richard M. Hughes, III of the Luzerne County Court of Common Pleas issued a detailed Opinion addressing post-trial motions in an auto accident case in which the jury found both the Plaintiff and Defendant drivers negligent, but neither of the parties' negligence to be a substantial factor in causing the injuries alleged.

After finding circumstantial evidence of uncontroverted evidence that the Plaintiff sustained some form of injuries as a result of the accident, Judge Hughes ordered a new trial limited to the issue of damages.

A distinguishing fact in this case, differentiating it from other zero verdict personal injury matters, was that the defense did not present expert medical testimony at trial, but rather contested the Plaintiff's claims of spinal injuries through cross-examination and argument focusing on the alleged pre-existing nature of the Plaintiff's spinal conditions.

The court noted in its Opinion that there was no substantial contesting by the defense of the Plaintff's separate claims of head, thumb, and knee injuries.

While Judge Hughes noted that an "agreement between medical experts as to the existence of an injury sufficient to constitute uncontroverted evidence, but not necessary.  In other words, circumstances may arise that present uncontroverted evidence of an injury without an agreement between parties' experts"  Op. at p. 6.

While acknowledging that a jury had a right to believe all, some, or none of the testimony offered by a witness, the court found that a jury could not reject testimony where the resultant verdict turns out to be "so disproportionate to uncontested evidence as to defy common sense and logic."  Op. at p. 10.

Here, the evidence presented by the Plaintiff on the head, thumb, and knee injuries were found by the court not to have been rebutted by the defense through a cross-examination of the Plaintiff's medical expert or otherwise.  Accordingly, the court ruled that the jury's defense verdict under the circumstances presented shocked one's sense of justice and that the Plaintiff was entitled to a new trial on damages.

No Habla Espanol?

According to the May 16, 2014 edition of the Luzerne Legal Register, the Luzerne County Court of Common Pleas has issued an Order amending Luzerne County Local Rule of Civil Procedure 1018.1 to require that any notice to defend attached to any Complaint filed by a Plaintiff or any Complaint filed by a Defendant against an Additional Defendant shall begin with a form Notice to Defend provided which sets forth the required language in both English and Spanish.  To review a copy of the proposed new form Notice to Defend required in cases in the Luzerne County Court of Common click this ENLACE, por favor.  

 
According to the May 2, 2014 Order of Court, this Rule will go into effect thirty (30) days after the date of publication of this amendment in the Pennsylvania Bulletin.  As of the writing of this blog post, I am not sure when that publication will occur).

Reassignment of Luzerne County Judges Announced (Effective January 1, 2014)

According to an October 21, 2013 Scranton Times Tribune article by Bob Kalinowski entitled "Luzerne County Judges Getting New Assignments," the Luzerne County Court of Common Pleas announced a planned reassignment of judges to be effective come January 1, 2014 for the civil, criminal, juvenile, and family courts.

To the extent, that you may not be able to access the article online (because you have to pay to view, or otherwise), I note that the article reports that Judge Lesa Gelb and Judge Richard Hughes will now focus on civil matters rather than civil and criminal matters as they have in the past.  President Judge Thomas F. Burke, Jr. will also continue to handle civil matters.

Judge William H. Amesbury has been appointed as administrator of the juvenile court but will also continue to handle civil matters.

Judge Michael T. Vough will continue to handle criminal and civil matters.

No other judges were identified as being assigned to take part in civil matters after January 1, 2014.

Third Circuit Addresses Appeal of Former Luzerne County Judge Mark A. Ciavarella, Jr.

According to a May 24, 2013 article entitled "Third Circuit Keeps Ciavarella Behind Bars" in The Legal Intelligencer by Saranac Hale Spencer, former Luzerne County Court of Common Pleas Judge Mark A. Ciavarella Jr.’s appeal of his 28-year sentence for his involvement in the “kids-for-cash” scandal has been almost entirely rejected by the U.S. Court of Appeals for the Third Circuit.
 
That Court of Appeals found no merit to his challenges other than his argument that one count of honest services mail fraud should have been time-barred. The court vacated that conviction. However, the vacation of that portion of the conviction will have no effect on the amount of time Ciavarella will serve. Rather, it only serves to reduce the amount that he will pay as part of a special assessment.

Luzerne County Local Rule Streamlines Motion to Compel Discovery Process



The following reminder of a recent new Luzerne County Local Rule pertaining to, and streamlining, Motions to Compel Discovery was highlighted in the Luzerne Register:



NOTICE TO ALL LAWYERS


208.3(b) Alternative Procedures

Cite Rule as: Luz. Co. R.Civ.P.208.3(b)

A Motion to Compel Answers to Interrogatories and/or Responses to Request For Production of Documents, where no objections have been filed, shall be submitted to the Motions Judge along with a proposed Order requiring the opposing party to provide full and complete answers within thirty (30) days or suffer such sanctions as the Court deems necessary.

Notice of Intention to Present the Motion to Compel must be provided to all parties of record not less than three (3) business days prior to the date of presentation and must be attached to the Motion. A brief in support of the Motion shall not be required.

Adopted: 05/15/2012

Effective: 08/15/2012

A NEW ERA DAWNS: Luzerne County Has Six New Judges (And a New D.A.)

According to the unofficial results, the six new Luzerne County Judges, in order of top vote-getters, are:

Jennifer Rogers

Fred Peirantoni

Joseph Sklarosky, Jr.

Michael Vough

Dick Hughes

Lesa Gelb

According to the article, 'Hughes, 50, of Mountain Top, and Vough, 47, of West Pittston, are both longtime assistant district attorneys with their own private practices in which they concentrate on civil law.'

The article states that "Sklarosky, 42, of Mountain Top, has worked as a part-time assistant public defender and also has his own private practice."

The article additionally notes that 'Pierantoni, 53, of Dupont, has served for the past 20 years as a magisterial district judge in Pittston, while Gelb, 50, and Rogers, 44, have primarily worked as civil litigators, focusing on complex cases."


It is also noted that, in a stunning upset, incumbent District Attorney Jackie Carroll Musto, who had over 20 years experience as a prosecutor, apparently became another victim of the Luzerne County judicial scandal.   Stephanie Salavantis, who is only two years out of law school and who has never prosecuted a criminal case, prevailed in the election for District Attorney.

Powell Gets 18 Months at Sentencing

Here is a link to a November 5, 2011 article from the Times Leader by Terrie Morgan-Besecker outlining the sentence handed down by Federal Middle District Court Judge Edwin Kosik on November 4, 2011 to former attorney Robert Powell for his guilty plea conviction for his role in the Luzerne County matters:

Powell, 53, was sentenced to 18 months in prison and fined $60,000.  He was ordered to present himself to prison at the end of this month to begin his sentence.

Former Luzerne County Judge Michael T. Conahan Sentenced to 17.5 Years in Prison

On Friday, September 23, 2011, former Luzerne County President Judge Michael T. Conahan, 59, was sentenced by Federal Middle District Court Judge Edwin M. Kosik to 210 months, or 17.5 years,  in federal prison for his part in the Luzerne County judicial scandal.  Conahan pled guilty to his crimes and received a sentence of almost 10 years less than co-Defendant, former Luzerne County Judge Mark A. Ciavarella.
 
Kosik additionally ordered Conahan to pay more than $874,000 in restitution, along with other fines. Judge Kosik also recommended that Conahan be sent to a prison in Delray Beach, Florida "not for convenience" but so that his family can be in close proximity
 
Before the sentence was handed down, Conahan sat as he read a prepared statement accepting responsibility for his actions and apologizing to all of those he harmed.  He told the court, "...the system was not corrupt.  I was corrupt."

Update on Luzerne County Matters

Former Luzerne County Judge Mark Ciavarella Transferred to Oklahoma Federal Prison

According to a September 8, 2011 article by Dave Janoski in Scranton's Times Tribune, former Luzerne County Judge Mark Ciavarella has been moved from a Philadelphia detention center to a federal prison transfer center in Oklahoma City, Oklahoma.  The article notes that he will be transferred from that center to another federal prison at some point.  Ciavarella was sentenced last month to 28 years in prison.

Former Judge Conahan to be Sentenced on September 23, 2011


Former Luzerne County Judge Michael T. Conahan will be sentenced by Federal Middle District Judge Edwin M. Kosik on corruption charges on Sept. 23 at 9:30 a.m. in the Federal Courthouse in Scranton.

Conahan pleaded guilty last year to a federal racketeering charge that carries with it a maximum possible sentence of twenty years in prison.
